What SB 721 and SB 326 Require
SB 721 applies to apartment buildings with 3 or more rental units. It requires inspection of all exterior elevated elements — decks, balconies, stairways, and walkways six feet or more above grade — on a 6-year cycle, enforced under Health & Safety Code §17973.

SB 326 applies to condominiums and HOAs with 3 or more attached units. It requires the same category of inspection on a 9-year cycle, to a 95% statistical confidence standard, and by law can only be performed by a licensed architect or a licensed civil or structural engineer — not a general contractor. It's enforced under Civil Code §5551.

Both laws require the inspection to identify emergency conditions and report them to the building owner and local enforcement agency within 15 days of discovery.
